Welcome to the eb-cosmetics.com website (hereinafter: “the Website”).

The Website is operated by Einav and her partners (Reg. No: ……) (hereinafter: “the Website Administration” or “the Company”).
The Website serves as an e-commerce platform offering, among other things, various products for sale (hereinafter: “the Products”).

General

    1. The content of these regulations refers equally to both genders, and the masculine form is used solely for convenience.
    2. The provisions of these regulations and the terms of use appearing on the Website define the legal relationship between the purchaser and the Website, the terms of use of the Website and/or product orders, and indicate the purchaser’s agreement to these and other terms on the Website.
    3. The Company may, at its sole discretion, update these terms at any time.
    4. These terms apply to the use of the Website and its services via any computer or communication device (e.g., mobile phones, tablets, etc.) and to use through the Internet or any other communication network.
    5. Nothing in these regulations shall derogate from the provisions of the Consumer Protection Law, 1981 (hereinafter: “the Consumer Protection Law”) and the regulations enacted under it, as applicable to the Website (hereinafter: “the Provisions”), except in cases where deviations are permitted and such deviations were made explicitly or implicitly on the Website.
    6. The Company and Website Administration do their utmost to provide complete and comprehensive product information, including images. However, unintentional inaccuracies, errors, or omissions may appear on the Website, and the Company and Website shall not bear any responsibility arising from them.
    7. Section headings are provided for convenience and user orientation only and shall not be used for interpreting the regulations.
    8. Typographical errors in the description of any product shall not bind the Company.
    9. Product images are for illustration purposes only. There may be differences in appearance, color, size, etc., between how a product appears on the Website and the actual product.
    10. No content from the Website may be copied or used, nor may others be allowed to use it, including in other websites, electronic publications, printed materials, and the like, for any other purpose.
    11. The timestamp recorded in the Company’s systems shall be the determining time for all purposes.
  2. Website Registration
    1. To place an order, the purchaser must register via the registration form on the Website.
    2. Any person, including a company, may use the Website and make purchases, subject to legal capacity and possession of a valid credit card issued by a recognized credit card company (hereinafter: “the Purchaser”).
    3. Registration is a one-time process; after registering, the purchaser will not need to register again to make future purchases.
    4. During registration, the Purchaser must enter a username, password, and email address. Consent to receive direct mailing under the anti-spam law is required and does not constitute grounds for any claim.
    5. If the Purchaser forgets the password, the original password entered during registration will be sent to their registered email.
    6. For future purchases, identification will be done using the username and password selected during registration.
    7. The Purchaser’s details will be updated according to the information provided in the online registration form.
    8. The Website Administration may request additional identification information at any time.
    9. The Company may, at its sole discretion and without prior notice, temporarily or permanently prevent anyone from using the Website, including in the following cases:
      1. Engaging in illegal activities and/or violating the law.
      2. Violating these terms.
      3. Knowingly providing false information.
      4. Performing an action that may disrupt the normal operation of the Website and/or harm suppliers or any third party.
      5. Blocking or restricting the Purchaser’s credit card in any way.
  3. Purchasing Products on the Website
    1. To purchase products, the Purchaser must add them to the shopping cart and complete the order form with their full details, including recipient information and delivery instructions.
    2. To prevent delivery errors, the Purchaser must provide accurate and correct information and verify it.
    3. During checkout, the Purchaser must confirm the order and the accuracy of the details provided.
    4. Providing complete and accurate information is required for the efficient processing and delivery of the order.
    5. The purchaser’s details will be updated according to the online form.
    6. Completion of the form is considered an order (hereinafter: “the Order”). The Website will verify the payment method, and upon approval, the order will be finalized and charged, subject to product availability.
    7. The details provided in the order form serve as conclusive evidence of the actions taken.
    8. Returns:
    9. For exchanges and/or cancellations, the product must be returned at the Purchaser’s expense in its original, unopened packaging, with the original invoice, and unused. Opening, touching, or applying the product constitutes use and invalidates exchange or cancellation.
  4. Payment Method
    1. Payment may be made via credit card or electronic wallet services such as PayPal (PAYPAL.COM), as available on the Website.
    2. If paying by credit card, the Purchaser will provide card details, ID number, card type, and expiration date. If paying by PayPal, the Company will charge only upon PayPal approval. PayPal terms apply.
    3. The Website reserves the right to discontinue any payment method, add new ones, or impose special conditions on different cards.
    4. After entering payment details, an email confirmation of receipt will be sent. This is not a binding order confirmation.
    5. The Company will verify payment methods before approving the order and charging the amount accordingly.
    6. If payment is not approved, the Purchaser will be notified, and the Company will contact them to complete or cancel the order.
    7. Approval of purchase is conditional on product availability at the time of order and delivery.
    8. If the product is out of stock despite being listed, the transaction will be canceled, and the Purchaser will be refunded.
    9. The delivery date is calculated from the date of payment approval.
    10. If the Purchaser is charged in error, they must notify the Website to receive a refund.
  5. Product Delivery and Shipping
    1. Products will only be delivered after payment approval and sent to the address provided in the online form.
    2. The Website aims to deliver products within the stated timeframe.
    3. Delivery will be within 14 business days via registered mail or within 10 business days by courier.
    4. Courier delivery is based on the courier company’s terms and coverage areas, with prior coordination.
    5. If delivery is not possible to the provided address, the Website will offer an alternative solution.
    6. Deliveries by Israel Post are subject to their terms, and the Website has no control over their service.
    7. Delivery times do not apply to out-of-stock products.
    8. Deliveries are handled by a courier company, and their terms apply to the customer.
    9. Shipping Fees: In addition to product prices, shipping costs will be added as shown at checkout unless stated otherwise.
    10. Shipping fees are paid along with the product charge, possibly as part of the first installment.
    11. The Website is not liable for any delay or non-delivery caused by:
      1. Force majeure (e.g., war, natural disasters, strikes).
      2. Emergency orders or lockdowns (e.g., COVID-19).
      3. Any reason beyond the Website’s control.
      4. Courier-related issues.
    12. The customer must notify the Website if the product is not delivered within the specified time to reschedule delivery.
    13. If products are returned due to incorrect address details, the customer will bear the return shipping costs.
  6. Order Cancellation by the Purchaser
    1. The Purchaser may cancel the transaction per the Consumer Protection Law. Specifically:
      1. Cancellation must be submitted in writing by email.
      2. Cancellation is not allowed for certain products as detailed in section 14c(d) of the law.
      3. The product must be returned, if possible, in its original packaging.
      4. Refund will be provided minus cancellation fees (5% of the transaction or 100 NIS, whichever is lower). Shipping fees are non-refundable. No cancellation fee applies in case of defects or non-conformance.
  7. Order Cancellation by the Company
    1. The Company may cancel an order at any time, at its sole discretion.
    2. A cancellation notice will be sent, and any payment will be refunded.
    3. Except for the refund, no other claims may be made against the Company.
    4. If the product is out of stock, the Website may cancel the order or offer a substitute. The Website is not liable for damages caused by such cancellation.
  8. Intellectual Property
    1. All intellectual property rights belong solely to the Company or licensed third parties.
    2. This includes product lists, descriptions, designs, and any Website-related content.
    3. This also includes the Website name, domain, and trademarks.
    4. No material may be copied, reproduced, distributed, marketed, rented, or translated without prior written consent.
    5. No deep linking or unauthorized content presentation is allowed without written consent.
    6. The Website may revoke deep linking permission at any time and without explanation.
  9. Liability
    1. The Company is not liable for any damage from the repair, installation, or replacement of products.
    2. The Company is not liable for damages caused by reliance on external websites linked via the Website.
    3. The Company is not liable for damages arising from Website usage or performance.
    4. The Company is not liable for the actions of third parties not under its full control.
  10. Privacy and Confidentiality
    1. All personal details will be kept in the Company’s database.
    2. Personal details will not be shared with others except as necessary to complete the transaction.
    3. Payment information is used solely for processing orders and is not stored by the Company.
    4. The Company may disclose personal information if legally obligated or to protect its rights.
    5. The Company may use non-identifiable data for statistics or analysis.
    6. The Company cannot guarantee complete protection from cyber breaches and is not liable for any resulting damage.

  11. Governing Law and Jurisdiction
    1. These terms and all activities arising from them are governed solely by Israeli law.
    2. The exclusive jurisdiction for any dispute lies with the competent courts in Tel Aviv-Jaffa.
    3. These terms and their interpretation are subject only to Israeli law.
